These Terms and Conditions of Sale ("Terms") govern the sale of products by BasedBodyWorks LLC ("Company," "we," "us," or "our") to you ("Customer," "you," or "your"). By placing an order with us, you agree to be bound by these Terms. If you do not agree to these Terms, please do not purchase products from our website, www.basedbws.com.
1. General
These Terms apply to all sales of products made by BasedBodyWorks LLC through our website. These Terms, together with your order confirmation, constitute the entire agreement between you and the Company regarding the purchase of products. We reserve the right to amend these Terms at any time without prior notice. Your continued use of our website following any changes will indicate your acceptance of the amended Terms.
2. Orders
All orders are subject to acceptance by the Company. We reserve the right to refuse any order. Upon placing an order, you will receive an email confirmation from us. This email does not constitute acceptance of your order by us but is merely an acknowledgment that we have received your order. We reserve the right to limit the quantity of products we supply, supply only part of an order, or divide orders into separate shipments.
3. Prices and Payment
All prices are expressed in United States Dollars (USD) and are exclusive of taxes and shipping costs unless otherwise specified. Payment for products must be made by credit card or other accepted payment methods as indicated on our website. We will charge your payment method at the time you place your order.
4. Delivery
Delivery times are estimates only and are not guaranteed. Products will be delivered within 5 to 9 business days from the date of dispatch. We are not liable for any delays in delivery. Deliveries are made to addresses within the United States only. You are responsible for ensuring the accuracy of the delivery address provided.
5. Risk of Loss
The risk of loss and title for products purchased from us pass to you upon our delivery of the products to the carrier. We are not responsible for any loss or damage to products after they have been delivered to the carrier.
6. Returns and Refunds
We accept returns of products within a 14-day period from the date of receipt. To initiate a return, please contact our customer support at help@thesupport.io or call +1 713-757-0948. Products must be returned in their original condition and packaging. You are responsible for the cost of return shipping. Upon receipt of the returned product, we will issue a refund for the purchase price, less any applicable shipping charges.
7. Warranty and Limitation of Liability
Our products are warranted to be free from defects in material and workmanship under normal use for a period determined by the manufacturer. This warranty does not cover damage caused by misuse, neglect, or unauthorized repair. Our liability for any defective product is limited to the purchase price of the product. In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, whether in contract, tort, or otherwise.
8. Force Majeure
We shall not be liable for any delay or failure to perform our obligations under these Terms if such delay or failure results from events beyond our reasonable control, including but not limited to acts of God, war, terrorism, strikes, shortages of supply, or any other force majeure event.
9. Governing Law
These Terms and any disputes arising from or relating to the performance or interpretation of these Terms shall be governed by the laws of the State of Texas, without regard to its conflict of laws principles.
10. Dispute Resolution
Any dispute arising out of or relating to these Terms shall be resolved through binding arbitration in Houston, Texas, in accordance with the rules of the American Arbitration Association. The arbitrator's decision shall be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
11. User Obligations
By using our website and purchasing products, you agree to comply with all applicable laws and regulations. You warrant that you are at least 18 years of age and possess the legal authority to enter into this agreement. You agree not to use our products for any unlawful or prohibited purpose.
